Right of withdrawal

If the Customer who has made a purchase on www.thehalvalab.com is a Consumer Customer, he/she is entitled to withdraw from the purchase contract, without stating any reasons, within 10 days.

The withdrawal period expires after 10 days from the day on which the consumer purchaser himself or a third party designated by him, other than the carrier, acquires physical possession of the goods.

In the case of contracts relating to the delivery of multiple goods, ordered by the consumer purchaser in a single order and delivered separately, or of a good consisting of multiple lots or pieces, the right of withdrawal shall expire after 10 days from the day on which the consumer purchaser himself or a third party designated by him, other than the carrier, acquires physical possession of the last product, lot or piece respectively.

In order to exercise the right of withdrawal, the Consumer Buyer must inform Halva Italia s.r.l. of its explicit decision to withdraw from the contract by registered letter with return receipt, addressed to c.a. Ordini Web, Halva Italia s.r.l., via Stoccolma, 14 - 41049 Sassuolo (MO) or by email to the following address info@thehalvalab.com.

In order to comply with the withdrawal period, it is sufficient for the Consumer Purchaser to send the communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.

Effects of withdrawal

If the Purchaser withdraws from the contract, he will be reimbursed for all payments he has made to Halva Italia srl including delivery costs where applicable (with the exception of additional costs deriving from the Purchaser's choice of a type of delivery other than the least expensive type of standard delivery proposed by Halva Italia srl. ), without undue delay and in any case within 10 days from the date on which Halva Italia srl received the notice of withdrawal. The reimbursement will be made using the same means of payment used by the Consumer Purchaser for the initial transaction, unless the latter has expressly agreed otherwise; in any case, the Consumer Purchaser shall not incur any costs as a consequence of this reimbursement.

The refund may be suspended until the actual receipt of the goods.

If the Purchaser Consumer has already received the goods, he must return or deliver the goods to Halva Italia s.r.l., via Stoccolma, 14 - 41049 Sassuolo (MO) srl, without undue delay and, in any case, within 14 days from the day on which he communicated the withdrawal to Halva Italia srl. The deadline is met if the Consumer Purchaser returns the goods before the expiry of the 10-day period.

The direct costs of returning the goods will be borne by the Consumer Purchaser.

The consumer purchaser is only responsible for the decrease in the value of the product resulting from the handling of the product other than that necessary to establish its nature and characteristics.

Exclusions

The right of withdrawal is excluded not only in cases where the customer is not a consumer within the meaning of the Consumer Code, or requires an invoice, or where the consideration does not exceed EUR 50, but also in the case of:

• order of products that are likely to deteriorate or expire rapidly;
• order of sealed Products that are not suitable for return for hygienic or health protection reasons or that have been opened after delivery.
• order of customised products at the request of the consumer purchaser

The right of withdrawal applies only to Products purchased on the thehalvalab.com website which can be returned to Halva Italia srl and put back on the market without risk to the health of the consumer.
